These Terms & Conditions ("Terms") govern your access to and use of KimberlyArtley.com (the "Site"), including any purchases, assessments, applications, inquiries, or other interactions you make through the Site.

The Site is operated by Kimberly Artley ("Kimberly Artley," "I," "me," "us," or "we").

By accessing, browsing, registering an account, making a purchase, submitting an inquiry, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility and Acceptance

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account or make a purchase through the Site. By using the Site, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

If you are accessing the Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Accounts

Registration

To access certain features — including purchased content, the Behavioral Wellness Assessment, and the Mentorship Intake & Portal — you may need to create an account. You can register using an email address and password or through Google sign-in.

When you register with an email and password, we send a one-time verification code to confirm your email address. Your account is not active until verification is complete.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use or security breach.

You may have one account per person. Accounts are personal and may not be transferred or sold.

Account Information

Your account stores your email address and, where applicable, your purchase history, assessment records, intake responses, and library access.

3. Purchases and Payments

Payment Processing

Purchases through the Site are processed by a third-party payment processor. Your card information is collected and handled directly by the payment processor on its secure hosted checkout page — it is never received, stored, or transmitted by KimberlyArtley.com.

When you make a purchase, a record of the transaction (including the offering, amount, and your purchaser email) is stored in the Site database so we can grant and manage your access.

Pricing and Availability

Prices for offerings are displayed on the Site at the time of purchase. We reserve the right to change pricing or to add, remove, or modify offerings at any time without prior notice. A purchase is confirmed only when the payment processor confirms payment.

Anonymous Checkout

For certain offerings — including the Dog Walking Meditations audio collection and the Private Behavioral Consultation — you may complete a purchase without first creating an account. Accountless purchases are accessed through a secure access token delivered to your email address after payment. For the Private Behavioral Consultation, this token provides durable access to your consultation status, payment progress, and deliverables without requiring an account. For the Dog Walking Meditations, you will be invited to create an account using the email address from your purchase so you can access your content anytime, from any device; if you do not create an account, your purchase remains valid but ongoing access is limited.

Complimentary Access

From time to time, complimentary access may be offered at our discretion. The terms of any grant are determined by us and may be modified or withdrawn at any time.

4. Digital Products and Access

Educational Offerings

The Site offers digital educational products including Masterclasses, Online Courses, audio programs and collections (including Dog Walking Meditations), downloadable companion resources, and other digital educational materials.

Access Granting

Access to digital content is granted upon successful payment. For authenticated purchasers, content is available through your Library. For anonymous purchasers, access is available through the post-purchase confirmation flow and, once an account is created, through your Library.

License and Permitted Use

When you purchase a digital product, you receive a limited, personal, non-exclusive, non-transferable license to access and use that content for your own personal, non-commercial use. This license is tied to your account and may not be shared, transferred, or resold.

No Right to Redistribute

You may not copy, reproduce, redistribute, resell, share, broadcast, publicly perform, record, scrape, download (where downloads are not expressly enabled), or otherwise exploit any digital content from the Site, in whole or in part, without prior written permission.

Credential Sharing

You may not share your account login credentials with others or allow others to access purchased content through your account. We reserve the right to suspend or terminate access if we believe credentials are being shared in violation of these Terms.

Downloadable Resources

Certain offerings include downloadable companion resources (worksheets, workbooks, guides, checklists, transcripts). Downloads, where enabled, are for your personal, non-commercial use only and are subject to the same restrictions on copying and redistribution.

5. Behavioral Wellness Assessment

The Behavioral Wellness Assessment is a paid, asynchronous professional service through which you submit information about your dog and receive a written assessment prepared by Kimberly Artley.

Information You Submit

The Assessment is based on the information you provide, including your dog's behavioral history, environment, relationships, lifestyle, and any other details requested. You may also upload a photograph of your dog. The more complete and accurate the information you provide, the more meaningful the resulting insight can be.

Based on Information Provided

Unless expressly stated otherwise, the Assessment is conducted primarily through the information you share. Kimberly Artley has not directly observed your dog in person, your home or environment, or the circumstances in which the behaviors you describe have occurred, unless a separate in-person engagement has been arranged.

No Veterinary or Medical Diagnosis

The Assessment is a behavioral wellness service, not veterinary care or medical treatment. It does not diagnose, treat, or cure any medical condition. If your dog has a medical issue or a behavioral concern that may have a medical cause, please consult a licensed veterinarian. In an emergency, contact your veterinarian or an emergency veterinary clinic immediately.

Professional Time

Purchasing the Assessment initiates access to an individualized process and, following submission, involves Kimberly Artley's personal professional time reviewing your information and preparing the written assessment. See the Refund & Cancellation Policy for refund terms specific to this service.

Submission and Delivery

Once submitted, your Assessment responses are finalized and cannot be edited. The written assessment is delivered through your account within the timeframe described on the offering page.

6. Consultancy, Mentorship, and Professional Services

Private Behavioral Consultation

The Private Behavioral Consultation is a professional service purchased through the Site. It is an approximately 2–2½ hour live assessment and consultation conducted virtually. The consultation includes a Notes & Reflections packet. It is an assessment and consultation, not a training session or board-and-train program. The full $397 balance must be paid before scheduling. Purchases of the Private Behavioral Consultation are additionally governed by the Private Behavioral Consultation Agreement and the Consultation Refund, Cancellation & Rescheduling Policy, which control in the event of any conflict with these Terms.

Mentorship

Mentorship is a professional relationship initiated through an inquiry and, if invited, an intake process. Mentorship is selective and is offered at Kimberly Artley's discretion based on the information provided in the intake.

Applications and Inquiries

When you submit an application, inquiry, or intake form, the information you provide is used to evaluate and respond to your request. Submitting an application or inquiry does not guarantee acceptance into any program or engagement.

Separate Terms

Mentorship or other professional services arranged separately from an online purchase may be subject to separate scheduling, cancellation, rescheduling, payment, and refund terms communicated in connection with that engagement. Those terms govern that engagement where applicable.

7. Educational and Informational Nature of Content

All content on the Site — including Masterclasses, Online Courses, audio programs, assessments, articles, and other materials — is provided for educational and informational purposes only.

The content reflects Kimberly Artley's professional experience, methodology, and perspective. It is not a substitute for individualized professional advice tailored to your specific circumstances.

8. No Veterinary, Medical, or Emergency Advice

Nothing on the Site constitutes veterinary, medical, or emergency advice, or a veterinary, medical, or behavioral diagnosis. If your dog is experiencing a medical issue or a behavioral concern that may have a medical cause, please consult a licensed veterinarian. In an emergency, contact your veterinarian or an emergency veterinary clinic immediately.

The Site does not create a veterinarian-client-patient relationship between you and Kimberly Artley.

9. User Responsibilities

You agree to use the Site lawfully and to provide accurate, complete, and truthful information when submitting forms, assessments, applications, inquiries, or purchases.

You are responsible for the accuracy of the information you submit, particularly in the Behavioral Wellness Assessment, where the quality of the insight depends on the quality of the information provided.

You agree not to:

• use the Site for any unlawful purpose;
• provide false, misleading, or inaccurate information;
• attempt to gain unauthorized access to the Site, other accounts, or systems;
• interfere with or disrupt the Site or its servers;
• use automated means to scrape, harvest, or extract content;
• share, resell, or redistribute purchased content;
• share account credentials with others;
• exploit the Site or its content for commercial purposes without permission; or
• reverse engineer, decompile, or disassemble any part of the Site.

10. Intellectual Property

Ownership

All content on the Site — including books, writing, courses, masterclasses, audio programs, the Behavioral Wellness Assessment methodology and framework, articles, photographs, videos, audio recordings, downloadable resources, branding, design, and other original content — is owned by Kimberly Artley and is protected by copyright, trademark, and other intellectual property laws.

Trademarks

"Kimberly Artley," "KimberlyArtley.com," "Dog Mom University," "You Had Me at Woof," "Dog Walking Meditations," and related names, logos, and marks are trademarks of Kimberly Artley. You may not use them without prior written permission.

Permitted Use

You may view and use the Site for personal, non-commercial purposes. Purchased content may be accessed and used as described in these Terms. Any other use, reproduction, or distribution requires prior written permission.

User Submissions

When you submit information through the Site (contact forms, assessments, applications, intake forms), you retain ownership of your personal information. By submitting, you grant us a limited license to use the information you provide for the purpose of responding to your inquiry, conducting the assessment or engagement, and operating the Site. You represent that you have the right to submit any information you provide, including any photographs.

11. Third-Party Services and Links

The Site integrates with third-party services for payment processing, email delivery, newsletter management, media hosting and delivery, authentication, and application hosting and infrastructure. These third-party services have their own terms, policies, and practices. We are not responsible for the practices of third-party services. Your interactions with third-party services are governed by their respective terms and policies.

The Site may also link to third-party websites or content that are not controlled by us. We are not responsible for the content or practices of any third-party site.

12. Availability and Modification of Services

We strive to keep the Site available but do not guarantee uninterrupted access. The Site may be temporarily unavailable due to maintenance, updates, or technical issues. We reserve the right to modify, suspend, or discontinue any offering, feature, or the Site itself at any time without prior notice.

We are not liable for any interruption, delay, or unavailability of the Site or any offering.

13. Disclaimers

The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

We do not warrant that the Site will be error-free, secure, or available at all times, or that any content will achieve a particular result. We do not warrant the accuracy, completeness, or reliability of any content.

14. Limitation of Liability

To the fullest extent permitted by law, Kimberly Artley shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Site or any content, offering, or service, whether based on warranty, contract, tort (including negligence), or any other legal theory.

In no event shall our total liability exceed the amount you paid for the specific offering or service giving rise to the claim.

Nothing in these Terms limits any liability that cannot legally be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Kimberly Artley from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, your infringement of intellectual property rights, or your inaccurate or unlawful submissions.

16. Termination and Suspension

We reserve the right to suspend or terminate your account or access if you violate these Terms, engage in unlawful or improper conduct, or for any other reason at our discretion.

Upon termination, your right to access the Site and any purchased content may cease. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — remain in effect.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, to the extent permitted by law.

Any dispute arising from these Terms or your use of the Site shall be resolved in the courts located in California, and you consent to the exclusive jurisdiction of those courts to the extent permitted by law.

18. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your use governs that use. Material changes will be reflected in a new version with an updated "Last Updated" date. Continued use of the Site after changes constitutes acceptance of the updated Terms.
